New laws to greet spring revelers

Those heading to Lake Havasu this weekend for boating and fun in the sun may not be aware of some new laws now in place.


To avoid undesired tickets and possible jail time, college students and tourists should become acquainted with three relatively new local laws relating to the lake and Bridgewater Channel.

The most controversial has become known as the behavior ordinance, and was vigorously opposed by the boating community and various business interests last summer.

Offensive Conduct in Public Places took effect last August and applies to all public places, not just the Channel and Lake Havasu. It gives officers greater flexibility by placing indecent exposure, public intoxication, violent acts and abusive or obscene language into a single city ordinance.

There is duplication. Only public intoxication did not already exist in state statute when City Council unanimously approved the behavior ordinance on July 11.

Intoxication is defined in Arizona as “any mental or physical incapacity resulting from use of drugs, toxic vapors or intoxicating liquors.” Violators are punishable with fines up to $2,500 and/or a prison sentence of up to six months.

Since its enforcement began, the largest fine levied among the 10 people cited and arrested has been $700, according to police.

Larry Reese, president of the Lake Havasu Marine Association, said the worst is over.

“When it was being talked about, there was a lot of misunderstanding. Since implementation, the Marine Association feels there will be no further damage,” Reese said.

He believes the Police Department is doing a good job of warning people before issuing tickets.

During Labor Day weekend, the last major tourist holiday, there weren't any arrests made under the new law.

A second law of note deals with mooring.

Unless a watercraft is moored to a designated tie down, boaters aren't allowed to moor, park, anchor or leave their watercraft standing within 25-feet of the Channel's east side.

Reese said that although the restriction is undesirable, it would have no long-term negative impact.

“Boaters, when they understand, are easily adaptable and just want to have a good time,” he said.

The Channel's east side has a concrete “sea wall” where watercraft can tie down. Posts are spaced 15 feet apart. A similar structure is being built on the Island side and should be completed by May, Reese said.

A third relatively new ordinance contains several parts:

No one may operate a boat in the Channel while a person is riding on the gunwales, transom or deck over the bow. There are exceptions for boats designed for carrying people at all speeds, or if the watercraft is preparing to anchor or moor.

Persons cannot block the view of a watercraft operator.

Except in an emergency, children younger than 12 may not operate a watercraft of more than eight horsepower in the Channel, unless accompanied by an adult.

Council OK'd rules on mooring and riding last September.

City Spokesman Charlie Cassens said there are no plans for educating spring breakers or other tourists before Memorial Day.

He said Lake Havasu City received a reputation as a spring-break town “not because of offensive behavior. Spring break is actually a pretty controlled event. The crowd is very well-behaved.”

If holiday crowds acted like the spring-break vacationers did, there would have been no need for the new rules, he said.

Gears of motion began turning on the controversial behavior ordinance last Memorial Day weekend. During a May 30 meeting, testimony given by Police Chief Dan Doyle convinced council members that the officer's job would be easier if the groups causing problems could be forced to leave the water.

Just who determines what is obscene, indecent or offensive?

The “reasonable-person” standard is commonly applied by judges and law enforcement to determine whether an action is offensive. Local officers are relying on this standard.

If you all want to act like that then do it at home or somewhere where all of you can get together and act that way...away from people who have the right to take our children to the park and not have to listen to or see what is not "real life" to us. Go to the sandbar, or on the other side of the lake. We are not telling you not to be who you want to be...we just don't need to see it or hear it. If most of you were under control that is fine, but it just seems that most of you are not. This is my town...I live here 365 days a year. This is where I raise my children, and I have rights too, and I will fight for them. "

    " I would rather have the snowbirds in our restaurant anyday than rude, arrogant, drunk, loud, obnoxious spring breakers who only bring in more of their kind.(This is not all spring breakers but a good 95% of them.)Snowbirds at our restaurant come in the same time as everyone else and never ask for a senior discount...they are quiet, respectful, and spend just as much money as spring breakers. The usually tell their friends about the place and they are here the whole winter not just one week out of the year. So I would much rather have them..."just wondering". Here's a clear example of what is wrong with the police force on the lake. Last week, our first day on the lake of 2007, we pulled into the channel around noon to wait for a few more friends to meet up. After getting everyone on board an hour or so later, a couple guys pushed the boat off the shore as I reversed and everyone on board got situated putting things away and finding a seat. As I shift into forward to head out of the channel, I'm standing up driving with a completely clear view as I tell everyone on board to take a seat. As I am shifting into forward, a police boat parked 3 or 4 spots away sounds their siren and tells me to pull onto the beach. I explained that I read the new laws in the paper and that I had just pulled out of our spot and was telling people to sit down as I was shifting into forward when he asked “why I was ignoring the laws if I knew them.” That was the end of it; they wanted nothing more than to waste my time. The next day: The following day on the lake we ended up back in the channel around 5 pm to drop a few people off and hang out for a little longer on our way to Windsor. As we are hanging out in the channel two typical tattooed Havasu locals tried to start a fight with someone on my boat. I immediately started the boat and backed off of the beach before anything happened. As we are getting to Windsor, a boat comes racing up behind us with at least 12 people on board of which 2 were females. They circled us throwing beer cans, sunscreen bottles and anything else they could get their hands on for at least 15 minutes screaming for us to pull up on the beach and fight. We called the police about 2 minutes into this and they never showed up until 20 minutes later. When the boat finally left and I dropped someone off on the docks to go get our trailer two LHPD patrol cars finally showed up and then 4 Sheriff boats 2-3 minutes later. After taking our information they raced off towards the channel and that was the last we ever heard. We called the police the next day to find out if anything came of it and they had absolutely no information to give us. "

I remember "old" Havasu when people had fun on the Lake without this whole mess that has been created, or rather allowed to continue for so long. Now there is no way I would bring my children to the lake on a holiday weekend. I can't even take my kids to the grocery store without seeing literally half naked women. I have nothing against beautiful women...yea they are pretty, but it just isn't right to walk around in a grocery store like that. A woman had a thong on...inside of Safeway. I can't bring my dog in the store becasue it's not sanitary, but women and shirtless men can walk in with almost nothing on and that is sanitary. Do they not know how much dead skin we shed every day??? It's sick. AND I don't need my little ones seeing things that they should not be seeing yet. I have heard of women being asked to leave places because they started breast feeding their babies, and yet this is tolerable. Is it too hard to just put a cover up on??? Are businesses so messed up in the head that all they care about is making a buck??? Business owners HELLO if you ask them to put on a shirt they will still buy beer and ice. Step up and do the decent thing. I really am glad that residents are standing up and telling the city what they think. We don't mind people having fun. Havasu has fun people, but don't disrespect our house. This is where we live. If I invited you into my house for the weekend and you got stupid drunk, started yelling profanities around my family, and then walked into my kitchen or family room with nothing but a few strings on....I would kindly ask you to leave. That is what is happening to our town. It is disrespectful. We live here, we pay the taxes, we raise our children here, we Lake Havasu City residents want better for our town. A boat with a stench or reefer should also be searched and arrests should be made. It is a standard law. If people want to have the casual sex for the sake of unwinding, let them if in private. The fact that 99% percent of women the age of 50 will have an STD is another story . . . but anywho who are we to judge. We just feel that the Lake havasu city police have a little too much authority. The public profanity law has become the joke of the UA and ASU campuses. A running gag is to tell your friends that they;d be in cuffs if they said that in havasu. Lets state facts. The police department of LHC has been corrupt in the past for a long time. FACT. With such a history, one has a right to suspect that something could also be going on now? FACT. I am surprised LHC residents still respect the PD after the scandals. I figured they would have lost their legitimacy. In conclusion of this rant, just make the laws the same statewide. From my understanding, national law trumps state law and state law trumps city law . . . city law tends to always be the same as the state. At least that is what one year of law school gets you "

Maybe instead of sending all the police to the party spots they should be out patroling the lake for the boaters that are driving out there drunk or not even drunk but cutting off other boats or driving on the wrong side of the lake. instead you are so concerned with the loud,the nude etc. You are going to turn Havasu in to Palm springs In our day that was the spring break spot then that Mayor and council cracked down and look what happened to those buisness. I get up at 6:30am take care of my son ALL day focusing on other things all day other than myself, and then go to work at night. How is that fun?? How is not remembering what you did the night before fun?? I"m not saying that your day is not stressfull, as I am not saying that mine is more stressful that yours. There are ALOT of people that have much more stress on them than they could ever want, and they don't NEED reckless destructive behavior to unwind. When did all of this become the norm??? When towns like ours allowed it. We let it go to far and now people think it's ok. IT'S NOT OK. Thank God for the rules...they keep you and others out of trouble....not from having fun. Go back to when you were a kid and be creative...do something for someone else other than yourself, hang out with friends. Go to Disneyland!!!!! You are never to old to go there! Or still hang out in Havsau with new boundaries and discover real fun!! Do something positive with your whole life (meaning the down time too) so that one day when you do have children they will be able to look up to you in all areas of your present and past! "

    " Anyone who has such a problem with spring breakers either never went to college themselves or is a victim of hypocrisy. College is a lot of work . . . our 18 hours of class a week isn't a total cakewalk. I am pre law. To achieve all A's, and i literally mean my 4.0, I must study about 4 hours a night. So the average day at school is probably 8-3 and then 4 added hours. The amount of stress is hard to describe unless you were a good student and lived with it yourself. Let us have a little fun. Imprison us for breaking actual laws. Just use equity Lake Havasu . . .treat us fairly! I think the Kokomos story was outrageous i read on the message board. I also posted the keys story. There are many more. Lake Havasu is in disarray for more reasons than just spring breakers! We spend our money here. Many of us have ties to the town! Above all, many of you in your late 20's on once partook in spring break activities if you are educated! Don't be victims of hypocrisy. Just because you are too old for something, don't act as if you are ex post facto and now no one can do it. It is kinda like my father; he used to race cars in his younger days, and now that he is older and done with that, he calls racing a waste of gas. "

    " I have a friend who always tells me, "It is what it is". Lake Havasu is what it is - and it is a great spot for Spring Break and all of the extra revenue that comes with it.
