Man sentenced to 4 1/2 years in shooting death
KINGMAN — A Lake Havasu City man was sentenced Thursday to 4 1/2 years in prison for shooting another man during a late-night brawl outside of a diner.
Jonathan David Alldredge, 24, had pleaded guilty to manslaughter as part of a plea agreement filed in Mohave County Superior Court. He had been charged with second-degree murder, a charge that carries a sentence of 10 to 22 years in prison. Alldredge shot Shawn Keenan, 29, on July 13, 2007, in an alley outside of Chili Charlie's restaurant on North Lake Havasu Avenue. Police said the shooting happened at about 11:15 p.m. after the restaurant was closed. Alldredge was arrested later that night in the 2100 block of Holly Avenue, reportedly loading luggage into his car. He told Judge Robert Moon that the shooting was done in self-defense, saying Keenan and two other men were trying to rob him. “I was afraid for my life,” Alldredge said. “I was defending myself. … I thought he was going to kill me.” During the hearing, Alldredge said Keenan had knocked him to the ground and tried to wrestle his gun away from him. Witnesses told police Alldredge pulled a Glock .40-caliber semiautomatic handgun out of his pocket and fired at Keenan four times, hitting him twice in the chest. Prosecutor Jeremy Huss said that given the facts, it would have been difficult for the state to get a conviction. He said a ballistics analysis showed the bullets had an upward trajectory, indicating that Alldredge was probably on his back when he shot Keenan. That is usually a sign of a shooting carried out in self-defense, Huss said. “I think it’s an appropriate resolution,” he said after the hearing. “Self-defense cases are extremely difficult for us to prove. This case would be no exception.” The case was problematic for other reasons as well. One of the men who was with Keenan during the alleged robbery attempt disappeared after the shooting. The other has changed his story several times since the night of the shooting, Huss said. The autopsy revealed that Keenan’s blood-alcohol level was 0.34 percent when he was killed, perhaps making him a less sympathetic victim to a jury, Huss said. At the hearing, Alldredge’s hands were cuffed to his waist, his ankles were shackled, and he wore orange jail scrubs. He appeared remorseful when he described how he shot Keenan. “Your honor, I’m very sorry for what happened,” he said. When Moon handed down the sentence, Alldredge stared straight ahead, showing no visible reaction. Several of his relatives sobbed as he was escorted back to the Mohave County Jail. None of Keenan’s relatives were in the courtroom. However, Huss said Keenan’s sister and aunt had agreed to the plea agreement. Before he was killed, Keenan lived in Bangor, Maine. He moved to Arizona in April 2007, working as a painter. A call to the mother of Keenan’s child, Angie Hawkes, was not immediately returned. You may contact the reporter at raap@havasunews.com. "[/Q] Well, if we say Keenan was in the guy's face then it wouldn't be much of stretch to also assume Keenan meant bodily harm. Then it doesn't take much imagination to assume "The Victim" Alldredge; felt he was in eminent danger and fortunately had a way to defend himself against a larger and older assailant. If this had happened with an off duty Law Enforcement Officer and Keenan; there would have been an expedient and proper investigation finding the L.E.O. well within his rights. I agree with whomever said this young man shouldn't be in jail at all. Can't have it both ways; either it was justifiable or it wasn't. While I understand there is a grey area in any situation; methinks the grey area is a bit too big in this circumstance. I hope, with what little I know about this, Keenan gets his record expunged soon so he can get back to a normal life. When I hear of a 21 yo young man getting 3.5 years for relatively minor traffic infraction it seems doubly odd that another young guy gets so little time if was truly found guilty for manslaughter. Just my thoughts and opinion on the limited info available here. Where do I leave my 2 cents? " imamouse wrote on May 7, 2008 12:07 PM: " Sissy
The law has been for years that if someone does break into your house you have a right to kill in self defense - as long as you stay inside or whatever - its a very vague law and actually I would think a good defense lawyer would be able to bust it apart. However just in the last 10-15 years or so it seems like even the self defense victims are getting jailtime when outside the bounds of domain (house) so difinetly seems like a double standard is going on in our justice system - but im not real suprised now are you? " Sissy wrote on May 7, 2008 3:44 AM: " This doesn't make sense. If it was self defense, he shouldn't have gotten any time. Someone comes into my locked doors, I wake up and shoot him, I am going to jail? Was this self defense or not? " Investigator wrote on May 6, 2008 9:46 PM: " Poor unintelligent guy, he had a bad attorney and he took the deal. The jury would not send him to jail. He was on his back when he was firing, that is a good indication of the self defense. It is not sure how he was carrying the gun, if the gun was visible or in the car, he is OK without the permit. Also the bar was closed. Poor unintelligent guy, looks like he has a low IQ. " Anonymous wrote on May 6, 2008 8:36 PM: " I think it is only fair to review some of the aspects of this that do not make sense. First they were supposedly outside smoking after closing time, second the other two guys were not carrying a lethal weapon. Let's not forget the fact that it was never reported this shooter had any injuries. You would think someone who was fearing for their life that was getting robbed by two guys with out weapons there would be a mark on him somewhere. It just doesn't make any sense. I still believe no matter what the rest of you state that this was an injustice. I am not saying that Keenan was innocent in this he probably did get in the guys face but does that deserve being shot at numerous times you would think at the most he would just shot a warning shot to make them get away. " Nameless wrote on May 2, 2008 9:21 PM: " I don't understand how they can call it self defense, yet still sentence him to prison time. That doesn't sound fair to me. If it's self defense, IT'S SELF DEFENSE. You shouldn't be punished for self defense. If this really was the case, I feel sorry for this guy being sent to prison for defending himself. Criminals have more rights and are protected more than victims. It's sad..... " Citizen wrote on May 2, 2008 1:08 PM: " "so cal resident" and "What is wrong": If this guy didn't have a permit to carry, that would have affected the outcome. Even if he did, he had been drinking and carried into an establishment that serves alcohol. Two very big no-nos when it comes to carrying concealed in AZ when you have a permit. Then you can throw in leaving the scene... No matter what, he made some bad choices in this situation that did not help his case at all. If you're going to carry, you have to do it the right way and follow the laws, because if you don't you're just another criminal. Given the limited information on his legal standing regarding to carrying concealed, I think this is a fair ruling. As for "Anonymous", you sound like someone who is uninformed and unaware or your rights as a citizen of the United States. " so cal resident wrote on May 2, 2008 12:01 PM: " I don't understand why they even charged they guy. The prosecutor said it looked like self defense in a robbery. So if two drunk guys 4 times the legal limit want to rob you just hand over your money and hope they don't kill or injure you???? I think he did the city a favor by shooting that guy maybe next time someone thinks of robbing a random person they will think twice. " What is wrong wrote on May 2, 2008 7:03 AM: " So this man does 4 years for a real case of self defense... while cruz gets to walk free after killing a man.. then goes out and does a drive by?? nice court system we have here " Anonymous wrote on May 2, 2008 6:21 AM: " I feel justice was definitely not served. A man has just gotten away with murder. This was not manslaughter this was not an oops I didn't mean to do that. Its one thing to accidentally shoot someone and another to actually pull the trigger to kill. It is a sad day when someone like this can serve four years and probably get out earlier anyway and then have the rest of his life to look forward too. He can still raise a family, he can still love other people and be loved in return. Keenan will never have that and neither will his children. I do not blame the mother of his child for not returning this phone call this is something she would rather assumably just have behind her. Sometimes stories and words are twisted and she would probably like to just stay out of it. As for this individual I guess you could say he got away with murder and he will meet his maker when his day comes and that is when he will receive his true punishment. "
