Police to give noise report
Findings could shape new city ordinance

At a Sept. 23 Work Session of the Lake Havasu City Council, the council requested the Police Department collect decibel readings across the city for a new proposed noise ordinance.

The request came after the Police Department suggested the council enact a new ordinance that would replace the existing one, which the Police Department and City Attorney’s office had stated was vague and subjective in certain areas.

Tuesday, the Police Department will present their findings to the City Council in a Work Session. If approved, the new noise ordinance could change the way the Police Department and the city determines what is an acceptable level within the city limits.

The Police Department would have a number of sound-level meters to register sound complaints, which would be determined from the sound levels at the location of the complaint, based upon the loudness from the origin of the complaint and the location of business or home where the complaint was filed. The meters include a microphone, amplifier, an output meter and frequency weighting networks used to measure sound levels.

The new ordinance would be defined with a number of exemptions when machinery is functioning in accordance with manufacturer’s specifications. Such exemptions include air-conditioning, pool or spa equipment, lawn maintenance equipment, school, governmental or community group activities, warning or alarm devices, emergency vehicles, construction, church bells or chimes, sporting events, traffic, special events, parades and motorcades approved by the City Council, City Clerk’s office or Developmental Services Department, noise resulting from animals, which would include animal boarding and veterinarian facilities, as well as, animal shelters and noise resulting from the Lake Havasu Municipal Airport.

Allowable noise levels would differ for certain days of the week.

Sunday through Thursday between 10 p.m. and 7 a.m. noise levels would be permitted no higher than 55 decibels. Between 7 a.m. and 10 p.m. the maximum level would be set at 65 dB. On holidays, Fridays and Saturdays, the same noise levels would apply with exception they would be established beginning and ending at 12 a.m. instead of 10 p.m. for residential areas.

Noise levels permitted for business areas would be somewhat higher. Levels between 10 p.m. and 7 a.m. could be no louder than 60 dB. Between 7 a.m. and 10 p.m. levels could register no higher than 75 dB for all days of the week and including holidays.

Manufacturing and industrial properties would have equally set levels for everyday of the week, including holidays, beginning at 60 dB from 10 p.m. to 7 a.m. and 85 dB between 7 a.m. and 10 p.m.

Holidays include New Year’s Eve, New Year’s Day, Christmas, St. Patrick’s Day, Memorial and Labor Day, 4th of July, Veterans Day and Thanksgiving.

Measurements would apply to any length of time beyond five minutes or the noise standard plus 10 dB at any time.

Any person found guilty of violating the code, would be convicted of a misdemeanor and could face fines of up to $2,500 or six months in jail.

Any business found guilty would be guilty of a misdemeanor and could face fines up to $20,000.

The Work Session will be held Tuesday, Dec. 23, at 5 p.m. inside the council chambers at the Police Facility. It is open to the public.

" I leave for a weekend to celebrate peace on earth, goodwill toward men and birth of man born to suffer under a repressive government for our sins. I come back to see some here posting in more hatred, wishing ill toward people and support of an oppressive police force. Some things never change I guess and the sad part is those that support the oppression don't even think it's wrong. This ordinance is all about oppression btw. It is overbroad and relies too much on vague guidelines with overly strict mandatorys. "

" It is apparent that every article written, and blogged about on here, goes back to bashing snowbirds and the PD. Could we just once post about the actual article? Lets just try it once-no snowbird or PD bashing. Lets see how long we can go with it.... "

" Why can't the moderator actually moderate the posting???
Seriously, this article is about the noise ordinance...
As for peoples continual 'PD' postings, I support them(and other departments) but this IS a small town & everybody knows that the PD has its problems.
As for the bashers, I can't disagree fully with you. There are things like trying to find out who's actually posting on here(I know that one for a fact), that really do iritate me, not just because it is cowardly but it goes to show how sensitive some of the PD guys can get about random posts. So next time you decide to post on here without really addressing the article, think about my feelings. Please? "

" cindy, there are many people here that support our local police. One bad cop does not spoil the whole bunch! I am curious as to why are are so angry at them?? I have yet to witness a bad cop. I am not saying they aren't out there but I have not witnessed, even one here. I have yet to read what you are doing to about it, other than blogging? If you have documented facts you should pursue them to the proper aunthorities. "

" From reading the posts, it does not appear like I am alone in supporing our community, the PD, the FD, the city, etc. Appears the handful of community bashers anti LHC posters are out numbered. Most want lawful, respectful visitors. You few who think we should turn a blind eye to criminal behavior for the tourist dollars are the minority. Most enjoy the community, those who sit online bashing it obviously do not. Sad. "

" This ordinance will just cause anger & confusion on how it is enforced. Unfortunately, this type of ordinance(I believe) is for the sole discretion of ticketing by prejudice. These levels are so low that anybody can be ticketed for almost any noise. In my eye it's pretty simple, loud disruptive noise is easily identified & I don't see the need to overly monitor sound levels to justify ticketing someone. I'm just glad that I get along with my neighbors... "

" Marvin M - rumor has it you are one of the LHC bashers under a different name. Stop trying to find a way to bash our public servants. They do not make the laws, only enforce them. And only 'wannabes' sit on their computer and pass judgement on the PD, FD and others who work hard for our community. "

" I looked up decibel ratings (http://www.gcaudio.com/resources/howtos/loudness.html) and a normal conversation at 3-5 feet is 60-70 decibels. So could a person be fined for talking normally in their yard after the posted "curfew" or will discretion come into play? During the summer, when people tend to migrate outdoors later in the day, how will this come into play? People enjoying their pools, sitting and talking under a mister. It sound too much like a "gated community" rule where everything is locked down after 10pm. "

" I looked up sound meters and found that any good ones are also very easily knocked out of calibration, like say being the trunk of a police car? Thrown on a seat? ect.
Given the discussions going on about the police here it seems odd they are openly looking for ways to shaft people. "
